Welcome to Gpt Image, an AI-powered creative platform operated by Gpt Image Dev and available at https://gptimage.page. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you and Gpt Image Dev. Please read them carefully before using our platform.

Service Description

Gpt Image provides an AI-powered creative platform that includes the following services:

AI Image Generator — Generate and edit images from text prompts or existing images using advanced AI models, including OpenAI's GPT Image 2
AI Video Generator — Create videos from text descriptions, images, or existing video content
AI Music Generator — Generate music and audio from text descriptions
AI Chatbot — Interact with AI-powered conversational assistants

Our services utilize third-party AI providers including Replicate, Fal.ai, Google Gemini, Kie.ai, and OpenRouter to process your requests.

Account Registration and Security

Account Creation

To access most features of Gpt Image, you must create an account. You may register using your email address or through third-party authentication providers (Google, GitHub). When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security and confidentiality of your login credentials
Accept responsibility for all activities that occur under your account

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at support@gptimage.page if you become aware of any unauthorized use of your account or any other breach of security.

Age Requirement

You must be at least 13 years of age to use Gpt Image. If you are under 18, you must have the consent of a parent or legal guardian to use our services.

Credit System and Billing

Credit-Based Usage

Gpt Image operates on a credit-based system. AI generation features require credits, which are consumed based on the type and complexity of each generation task.

Purchasing Credits

You may purchase credits through one-time payments or recurring subscriptions. Subscription plans are available in daily, weekly, monthly, and yearly intervals. All prices are displayed on our Pricing page.

Payment Processing

Payments are processed through our third-party payment providers: Stripe, PayPal, and Creem. By making a purchase, you agree to the terms and conditions of the applicable payment processor.

Refund Policy

All purchases are final and non-refundable unless otherwise required by applicable law. If you believe a charge was made in error, please contact us at support@gptimage.page within 14 days of the transaction.

Subscription Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to your remaining credits until they expire. No partial refunds will be issued for unused subscription periods.

Price Changes

We reserve the right to modify our pricing at any time. For active subscribers, price changes will take effect at the next billing cycle. We will provide reasonable notice of any price increases.

User-Generated Content and AI Output Ownership

Your Content

You retain full ownership of all content you provide to Gpt Image, including text prompts, uploaded images, and other input materials ("User Content").

AI-Generated Output

You own the output generated by our AI services based on your prompts and inputs ("Generated Content"). You are free to use, modify, distribute, and commercialize your Generated Content without restriction, subject to the following:

You are responsible for ensuring your use of Generated Content complies with applicable laws
AI-generated content may inadvertently resemble existing copyrighted works; you bear the risk of any intellectual property claims
We make no representations regarding the copyright status or protectability of AI-generated content in any jurisdiction

License to Us

By using our services, you grant Gpt Image Dev a limited, non-exclusive, worldwide, royalty-free license to process, store, and display your User Content and Generated Content solely for the purpose of providing and improving our services. We will not use your content for AI model training.

Content Storage

Your prompts, generation history, and chat conversations are stored on our servers to provide you with access to your history and to deliver our services. You may request deletion of your content by contacting us.

AI Accuracy and Disclaimer

AI-generated content is produced by third-party machine learning models and may:

Contain errors, inaccuracies, or biases
Produce unexpected or unintended results
Not be suitable for medical, legal, financial, or safety-critical applications

You acknowledge that AI-generated content should be reviewed before use and that Gpt Image does not guarantee the accuracy, quality, completeness, or appropriateness of any generated output. You use AI-generated content at your own risk.

Content Moderation and Prohibited Uses

Prohibited Content

You agree not to use Gpt Image to generate, upload, or distribute content that:

Is illegal or promotes illegal activities
Depicts child sexual abuse material (CSAM) or the exploitation of minors
Contains non-consensual intimate imagery or deepfakes of real individuals
Promotes violence, terrorism, or self-harm
Constitutes hate speech or discrimination based on protected characteristics
Infringes on the intellectual property rights of others
Contains malware, phishing attempts, or other malicious content
Is deceptive, fraudulent, or designed to mislead

Prohibited Activities

You further agree not to:

Attempt to bypass, circumvent, or disable content safety filters or moderation systems
Use automated tools to access our services in a manner that exceeds reasonable usage
Reverse engineer, decompile, or attempt to extract the source code of our platform
Resell, redistribute, or sublicense access to our services without authorization

TO THE FULLEST EXTENT PERMITTED BY LAW, GPT IMAGE DEV DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that:

The services will be uninterrupted, timely, secure, or error-free
The results obtained from the services will be accurate or reliable
Any defects in the services will be corrected
The AI models will produce content free from bias, errors, or harmful material

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GPT IMAGE DEV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

Your use of or inability to use the services
Any unauthorized access to or alteration of your data
Any content generated by AI models through our services
Any third-party conduct or content on our platform
Any interruption or cessation of our services

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Gpt Image Dev, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the services
Your violation of these Terms
Your violation of any third-party rights
Content you generate, upload, or distribute through our services

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Gpt Image Dev operates, without regard to conflict of law provisions.

Any dispute arising from these Terms or your use of the services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules. You agree to waive any right to a jury trial or to participate in a class action.

Termination

By You

You may terminate your account at any time by contacting us at support@gptimage.page. Upon termination, your right to use the services will cease immediately. Unused credits will not be refunded.

By Us

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, for conduct that we believe:

Violates these Terms
Is harmful to other users, us, or third parties
Constitutes fraud or abuse of our services

Effect of Termination

Upon termination, your right to access the services ceases. We may delete your account data in accordance with our data retention policies described in our Privacy Policy.

Changes to These Terms
